The most powerful court in the entire world, The Supreme Court of The United States of America, currently holds a split of 6-3 in favor of the Republican Party. The Supreme Court can overrule lower federal courts (district courts and federal courts of appeals) and state courts (including state supreme courts). It has the most powerful ability in American law - the ability to reverse and overrule final judgments.

The first issue at hand here is the fact that the court is politicized, this is my biggest issue with it. The rule of law should be isolated from any politics and should function as its own entity. The core issues that I believe have led to the demise of the integrity of the court and therefore the state of the law in America are the following:

  • First, the fact that there are no term limits. The most obvious and simple example of why this is a problem is the fact that Ruth Bader Ginsburg spent a lifetime fighting for several causes, most of which were reversed because she died while a member of the court, resulting in a Republican nominee taking her seat and reversing the things she fought for. The most important is the issue of the right to abortion in the United States of America. Ginsburg voted to protect women’s abortion rights in 2016 and 2020, yet Dobbs v. Jackson in 2022 removed the right to abortion and explicitly overruled it. Who casted one of the votes that overruled the right to abortion? Amy Coney Barrett, the judge that Trump appointed to replace Ruth. The second issue with no Term Limits is the fact that one president can “Pack the Court” (google this phrase to find articles about it). It’s a very simple idea, old judges from one party retire under a president from the same party, which grants youthful replacement Justices to that party, thus securing the Court for many more decades in favour of that party. George Bushes (H.W. Bush and W. Bush) and Donald Trump appointed 3 supreme court justices in their first terms in office, appointing a shocking third of the entire supreme court in just one presidential term.

These appointees pathed the road to the current crisis in the field of law that America is facing, where the rule of law is simply being ignored by wannabe-dictators.

  • Second, the justices are not held to any standards, especially by their respective Universities, where they studied law. I will use Yale for this example, looked at as one of the finest legal educational institutions in the world. Clarence Thomas, Samuel Alito and Brett Kavanaugh all graduated from there. These three are the core that erased the right to abortion and more importantly decided Trump v. United States, decided on July 1st, 2024. In this decision 6 judges voted in favor of granting presidential immunity from presidential prosecution to all of a president’s “official acts” - with absolute immunity for official acts within an exclusive presidential authority that Congress cannot regulate, such as the pardon, command of the military, execution of laws, or control fo the executive branch. Who were these 6 judges? Well, three of them were appointed by the Republican president Bush in one term. The three Justices that Trump appointed in his first term. This is, to me, beyond a reasonable doubt proof that the Court is fully politicized and does not act as an independent entity that should ensure the rule of law in the United States of America in good faith. This decision opened up the path for Trump to make a completely mockery of the United States legal system, issuing “executive orders” for any and all of his dictatorship-esque wishes, ignoring any standing law.
